SHIPPING

Same-day service on orders paid before 3:00 p.m., local warehouse time. Special shipping requirements are to be specified at the time the order is placed. As carriers, routes and weather conditions are beyond our control, we cannot be responsible for timely delivery in your area.

CLAIMS

Notify Pickelgear of errors within 48 hours of receipt of goods. Damaged goods and container must be held for the carrier to validate damage claim, do not discard shipping cartons.

RETURNS

Authorized returns only. Our Return Authorization Number must be marked on outside of box. Returns on purchases, within 15 days, subject to a 25% restocking fee (minimum $5.00 restocking fee). Embellished merchandise, is non-returnable. Discontinued merchandise (noted by * on our invoice) is not returnable. Unauthorized returns may be refused by Pickelgear or may require additional processing time and fees. No returns accepted on imprinted products.

EXCHANGES

Goods may be exchanged, within 15 days, subject to a 10% fee (minimum $2.50), reference original invoice, and obtain a Return Authorization before returning to Pickelgear.

DEFECTS

Please obtain Return Authorization Number and include a packing slip indicating items being returned. Please return defects within 30 days of purchase. Dyed shirts are not returnable. No freight compensation is given for defect returns.

COLOR GUARANTEE

Color cannot be guaranteed from one to another dye lot, style, size, or manufacturer. All accommodations will be attempted at the time your order is filled to complete it in one dye lot. We do not provide freight compensation for dye lot differences. Catalog representation may vary slightly from actual garments as a result of the paper printing process, and website color representation may vary based on computer monitors, hence should not be used as exact representation for purchase decisions.

PAYMENT TERMS

COD cash, prepaid, or credit card payment accepted on all new customer orders. Payment by Company Check requires approval of our Company Check Application on file.  Visa/Master Card/American Express payment accepted thru www.PayPal.com, resulting in loss of cash discounted pricing.

RETURNED CHECKS

Subject to $25.00-per-check charge.

SALES TAX EXEMPTION

Proof of valid sales tax license or resale permit must be on file to avoid sales tax.

Prices are subject to change without notice. Pickelgear makes all attempts to provide up-to-the-minute pricing available via our Web site, fax and printed material. However, as pricing fluctuates, please confirm pricing at the time your order is placed. Periodic sale flyers are provided via fax or email to keep you informed of the latest special offers.

As items become available and/or may be discontinued by Pickelgear and/or our suppliers, we reserve the right to withdraw styles, colors or sizes without notice. Please verify availability for peace of mind.

IMPRINTING METHODS

Imprinting is a method by which the items are printed on. Setup charges will include color ink matching, making a screen (stencil) for each color, and art creation. Usually there is no charge for additional colors up to 7.

SETUP CHARGES

Setup charges are for creating new screens, tapes, dies, etc. These are pieces which the equipment actually doing the imprinting requires. There are somewhat complex tasks, equipment, and materials utilized to create these pieces. Once your art, dies, screens, tapes, films, etc. are made. We can imprint from them in the future without incurring these types of charges again. Setup charges vary depending on the imprintinting method, complexity of the art, and number of colors being imprinted. Call us for details.

Faxes are not "camera ready" and are subject to art department redraw charges, if applicable.

Art charges are for creating or modifying the art to be imprinted. We do this in our very knowledgable Graphics department using IBM computers running the most current graphics software including:

Supplied Camera-Ready art is subject to approval. Most often, artwork is FREE. Our Graphics department can usually clean up or recreate your logo artwork for $25. Complex projects are billed at $55 per hour.

Trademark Usage Rights

All the logos and trademarks are registered trademarks and logos of their respective owners and copyright holders. They are provided only as a convenience for their lawful use, and should be used only by owner of the logo or trademark, authorized agents or affiliates, with proper permission from the copyright holders.

Any customer of Pickelgear.com represents and warrants to Pickelgear.com that he or she has the unrestricted right to use, copy and distribute each copyright, trademark, service mark, trade name, logo, statement, graphic, artwork, name, photograph, portrait, picture or illustration of any person or any other intellectual property in the way it is to be printed on or otherwise applied to the promotional merchandise ordered by the customer. All customers must agree to defend, indemnify and hold Pickelgear.com harmless from any claims, suits or actions alleging that the promotional merchandise ordered by the customer violates or infringes upon any rights of any third party.

All customers are solely responsible for obtaining proper permissions and licenses from third parties whose rights may be violated or infringed. To use any logo, trademark or copyrighted items, a customer MUST have written permission from the owner of the logo or trademark or copyright, or be an employee or authorized agent or affiliate of the owner. A customer may NOT use any logo or other graphic material in a manner which may infringe copyright. A customer also may NOT use any logo or trademark in a vulgar, libelous, disparaging or otherwise unlawful manner. Pickelgear.com assumes no responsibility for damages or any wrong doing that the customer may cause using a logo, trademark or copyrighted items. Pickelgear.com shall not be held liable for the unauthorized, improper, or illegal use of any logo or trademark or copyright that is printed on or otherwise applied to promotional merchandise ordered or purchased by the customer through Pickelgear.com.
